Xcel Seeks Colorado Supreme Court Intervention for Wind Farm Connection

Xcel Energy appeals to Colorado's highest court after a district judge blocked its bid to use eminent domain for a wind farm interconnection easement.

Public Service Company of Colorado, a subsidiary of Xcel Energy, is escalating its battle to connect two major wind projects to the grid. According to Utility Dive, a district court judge rejected the utility's eminent domain claim in June, which sought to acquire approximately 550 feet of easement rights to link the wind farms. The Xcel Energy projects, which together represent more than 1 gigawatt of generating capacity, are nearing completion but face grid connection obstacles.

The utility argues that the legal delays are creating tangible harm for its Colorado ratepayers by preventing the delivery of renewable energy resources and potentially increasing costs. Xcel's appeal to the Colorado Supreme Court signals the company's determination to overcome the property acquisition challenge that has stalled the interconnection process.

The case reflects growing tensions between utility infrastructure development and private property rights, as renewable energy projects increasingly require land-use agreements across multiple parcels. Xcel's decision to pursue appellate relief underscores how critical interconnection logistics have become in the broader transition to clean energy infrastructure.
